Automobile Liability Blanket, Contract Risk Transfer, Primary & Noncontributory Endorsement (CA 04 49 11 16)

Adds primary and noncontributory status for automobile liability, but does not include additional insured coverage. Coverage is extended to any person or organization required by written contract.

What Does This Coverage Include?

  • Modifies the Business Auto/Commercial Auto policy to address contract-driven risk transfer requirements—particularly Additional Insured status, primary and noncontributory wording, and waiver of subrogation.
  • Includes **Primary and Noncontributory** status, supporting contracts that require your auto policy to respond first without contribution from the Additional Insured’s auto coverage.
  • Written on a **blanket** basis, extending the applicable coverage to any person or organization required by written contract—often helpful for contractors working across multiple clients or job sites.
  • Commonly requested when a contract requires evidence that automobile liability coverage supports the risk transfer provisions in the agreement, especially where vehicles are used on or around a project site.

What Is NOT Covered?

  • The following coverages can be included if endorsed elsewhere
  • Additional Insured coverage: This endorsement does not add Additional Insured status for automobile liability.
  • Waiver of subrogation: This endorsement does not waive the insurer’s rights of recovery against required parties following a covered auto loss.

Why Is This Endorsement Important?

  • Supports contract language requiring your auto policy to be **primary and noncontributory**, reducing contribution demands on the other party’s auto insurance.
  • Streamlines compliance by extending applicable coverage to parties required by written contract, reducing the need to issue a new endorsement for each client or project.
  • Clarifies how liability is intended to be shared (or not shared) between parties, which can reduce disputes at claim time.

How Do You Review This Coverage?

  • Ensure that policy number - when printed - matches the COI
  • Ensure that expiration date - when printed - is not yet expired
  • Ensure that no invalidating watermarks (e.g. Sample) are included
  • Review any specific limitations or restrictive language.
  • Ensure the blanket language, if not broad, is applicable to your entities.
