Umbrella Liability Endorsement Overview Endorsement (CU-2225-1C)

Umbrella liability endorsement that does not add additional insured coverage, primary and noncontributory status, a waiver of subrogation, or follow form provisions.

What Does This Coverage Include?

  • Modifies an Umbrella/Excess Liability policy to address contract-driven risk transfer requirements, especially when large losses could exceed underlying general liability or auto limits.
  • Does not indicate additional insured coverage under the umbrella/excess policy, so contract requirements for umbrella additional insured status may need a separate umbrella endorsement.
  • Does not indicate additional insured, waiver of subrogation, primary and noncontributory, or follow form terms—so contract-driven umbrella requirements may need additional endorsements.
  • This is especially important when contracts require the umbrella to mirror the underlying risk transfer structure.
  • Used when contracts require umbrella/excess policies to mirror key risk transfer provisions and when severe claims could realistically pierce underlying limits.

What Is NOT Covered?

  • The following coverages can be included if endorsed elsewhere
  • Additional Insured coverage: This endorsement does not add Additional Insured status under the umbrella/excess policy.
  • Waiver of subrogation: This endorsement does not waive the insurer’s rights of recovery against required parties under the umbrella layer.
  • Primary and noncontributory status: This endorsement does not state that the umbrella/excess coverage applies on a primary and noncontributory basis for the required parties.
  • Follow Form: This endorsement does not indicate follow form terms that track the underlying policy conditions when the umbrella responds.

Why Is This Endorsement Important?

  • Indicates that key umbrella risk transfer features (Additional Insured, Waiver of Subrogation, Primary & Noncontributory, Follow Form) are not reflected here—so contract requirements may need additional endorsements.
  • Helps prevent gaps in the excess layer that can become critical when underlying limits are exhausted and multiple parties are named in a lawsuit.
  • Supports cleaner contract compliance and clearer allocation of defense and indemnity obligations when large claims occur.

How Do You Review This Coverage?

  • Ensure that policy number - when printed - matches the COI
  • Ensure that expiration date - when printed - is not yet expired
  • Ensure that no invalidating watermarks (e.g. Sample) are included
  • Ensure the boxes contain full blanket language or the additional insured entities and locations that match your contract.
  • Review any specific limitations or restrictive language.
